ROSEBURG, Ore. -- Dustin Wallace, 16, was arraigned in a Douglas County courtroom Monday afternoon on charges of aggravated murder and rape.

Wallace was indicted by a Grand Jury earlier this month for allegedly killing Sahara Dwight, 5, back on July 9. He was originally arraigned on the charges made by police investigators at the time of the incident. Monday's arraignment was for the charges brought by the Grand Jury.

The defense is asking for more time to gather all of the necessary information from the prosecution in order to go to trial.

Judge Randy Garrison set a status hearing for January 21, and they should be able to set a trail date by that time.

Even though he is only 16, Wallace is being tried as an adult and could face life in prison if convicted.

Wallace is not related to the victim but was staying at the home, police said. He was one of five people, including the victim, at the home on West Elaine Avenue when officers and paramedics arrived at 4:48 a.m.

Attempts to revive the child were unsuccessful. She was declared dead at the scene, and Wallace was later arrested.
