YACHATS, Ore. - A SWAT team shot and killed an armed man outside a home southeast of Yachats just before midnight Thursday.

The Lane County Sheriff's Office identified the man as Samuel Mullane, an 18-year-old resident of the area. 

A man and a woman inside the home surrendered to police several hours later.

According to the Lane County District Attorney's Office, the OSP SWAT team was assisting the Lincoln County Sheriff's Office as part of an ongoing investigation into a mid-May violent assault in Yachats. 

OSP SWAT troopers were conducting surveillance on a remote residence along Tenmile Creek Road about 7 miles east of Highway 101 when troopers encountered a male armed with a rifle outside the residence.

Three OSP SWAT team members fired at least one round each, fatally injuring the man.

After the shooting, an adult male and adult female inside the residence surrendered several hours later to officers and were transported from the scene. 

The adult male was subsequently taken into custody by Lincoln County Sheriff's Office related to the assault investigation.

Lt. Gregg Hastings with Oregon State Police said there may have been a third person at the residence as well.

"The third person we haven't located," he said.

The SWAT surveillance was prompted by information that three suspects in a mid-May assault case were located at the Tenmile Creek residence.

On May 10th a 46-year-old man was threatened by Julie Hubney, 54, with a handgun. The victim was then assaulted by three men, two of the subjects were identified as Matthew Hubney, 27, and Justin Wood, 25. The third person was also identified as a person of interest in the investigation. The man was taken to a Newport hospital with injuries caused by 'being struck with various weapons by multiple suspects'. 

Julie Hubney was taken into custody after a warrant search of the Hubney residence on charges of the unlawful use of a weapon and menacing with a $115,000 bail.

Felony warrants were issued for Justin Wood and Matthew Hubney on charges of assault, unlawful use of a weapon and criminal mischief. 

Information obtained by investigators said that Hubney, Wood and the person of interest were at the residence on Tenmile road. 

The three Oregon State Police SWAT team members, who each fired a single shot at Mullane, have been placed on paid administrative leave pending the outcome of a state-mandated investigation into the shooting. The officers were not injured. Their identities have not yet been released.

The Lane County Inter-agency Deadly Force Investigation Team is investigating the shooting. Per protocol in Lane County under Senate Bill 111, IDFIT is activated to conduct investigations into deadly force incidents. 

IDFIT is comprised of members from the Lane County Sheriff's Office, Eugene Police Department, Springfield Police Department, Florence Police Department, Cottage Grove Police Department, Oregon State Police, and Lane County District Attorney's Office.
