WALLOWA, Ore. (AP) - Oregon State Police say a trooper fatally shot a man in the northeast Oregon town of Wallow after the man pulled a handgun while being taken into custody.

State police say they were responding to a report of acts of public indecency Thursday night. They said the man was shot during a struggle. No further details were provided.

The name is being withheld pending notification of relatives. The names of the officers involved have not been released.

Wallowa County District Attorney Mona Williams has authorized the following information, including names of involved officers and the deceased male, for release pending the ongoing investigation into Thursday night's officer-involved shooting in Wallowa, Oregon.

On Thursday, May 21, 2009 at approximately 8:45 p.m., a Wallowa County Sheriff's Office deputy and two Oregon State Police officers responded to 308 North Pine Street in Wallowa regarding a report of an adult male performing acts of Public Indecency. The responding officers are identified as:

• Wallowa County Deputy Kevin McQuead, age not available, who has been with the Wallowa County Sheriff's Office (WCSO) for approximately 16 months and is an assistant firearms instructor. Before his employment with WCSO, Deputy McQuead worked about one year as a police officer with the Enterprise Police Department.
   
• Oregon State Police (OSP) Trooper Brian R. Miller, age 28, a 4 1/2 year veteran with OSP assigned in the Fish & Wildlife Division at the Enterprise work site.
   
• Oregon State Police Senior Trooper Berry Taft, age 55, a nearly 10 year OSP veteran who has worked at the Enterprise work site since 2002 and is currently assigned in the Patrol Services Division.

While the officers were attempting to take the male, identified as JAMES A. BLAIR, age 66, into custody he produced a handgun. During a struggle, BLAIR was fatally shot by an Oregon State Police officer.

BLAIR resided alone at the residence where officers responded to and the shooting occurred. Next of kin have been notified. An autopsy is pending by the Oregon State Medical Examiner's Office.

Deputy McQuead received minor injuries during the altercation and was later transported by an OSP trooper to Wallowa Memorial Hospital where he was treated and released following a medical evaluation.

The investigation is being conducted in accordance with Senate Bill 111 guiding investigations related to the use of deadly physical force by law enforcement officers. Investigators from the Union County Sheriff's Office, Wallowa County Sheriff's Office, and Oregon State Police are involved in this investigation with the assistance of the Wallowa County District Attorney's Office.

OSP Forensic Services crime lab personnel were working on scene this morning with investigators.

No additional details are being released at this time pending approval through the Wallowa County District Attorney's Office.
