Which light did he run? Citation says one thing, police say another
Bill Weaver is fighting this ticket for running a red light because the two lights are green at the same time. By Elissa Harrington KVAL News and KVAL.com staffALBANY, Ore. -- Bill Weaver is still fighting the ticket for allegedly running the traffic light on 9th Avenue and Lyon streets in Albany.
But Albany police now say Weaver ran the light on 10th Street that brings cars under the Pacific Boulevard overpass.
"He did not tell me which light I ran," Weaver said. "He told me I ran a yellow light." Weaver thinks the ticket was a mistake because his light was still green ...
... at the same time the officer's light turned green.
The two images above were pulled from a continuous video of the lights at the intersection -- and both are green at the same time. The Oregon Department of Transportation confirmed that the green lights overlap -- on purpose.
So if you're traveling along 9th headed toward the train station and that light turns green, the light taking traffic onto Lyon will stay green for at least a couple seconds. Last week, the Albany police records department said the light in question was the one Weaver thought he was ticketed for -- the light listed on the citation. This week, the police department is changing their story. In a phone interview, Captain Eric Carter told KVAL News he hasn't spoken to the officer involved but that he reviewed a dash cam tape after we called for an interview. He says the address on the citation is the general location. "That's really going to be where the officer was," Carter said. "But the light in question, because he was at the intersection of 9th and Lyon, which is where he was stopped in traffic several cars back, like I said it's a confusing thing. "He would not have seen the light," Carter said. The officer gave the ticket "based on timing. Where he was at, his light was green and traffic was beginning to precede when Mr. Weaver's car travelled through." Carter said police do not want to give out an inappropriate ticket but feel in this case it was appropriate. Weaver is planning an appeal. There have been 21 red light violations issued at that same intersection since 2005. |
