Police: Marine, 65, takes a punch - then takes down suspect

EUGENE, Ore. - A man who started throwing punches in the bottle return area at a grocery store took a swing at the wrong 65-year-old man Sunday night.

Police said Jacob Morton Berk, 19, began arguing with another patron returning bottles and cans at the Albertson's at 30th and Hilyard in South Eugene around 4:30 p.m.

Berk hit the man several times in the face with his fist, police said.

When a second person intervened and told Berk to stop, he punch that man in the face, too.

The 65-year-old Marine veteran responded by taking Berk to the ground and holding him down until officers arrived, police said.

Both victims suffered minor facial injuries from the assault, police said.

Officers arrested Berk on two counts of Assault, Criminal Trespass, Open Container and Disorderly Conduct.
