Police: Man who shot pot theft suspect indicted

SPRINGFIELD, Ore. - A man who shot someone he claimed was trying to steal his marijuana plants faces chrages of second degree assault and unlawful use of a weapon, Springfield Police said.

Police arrested Josiah Timothy Shirley, 30, at his home Thursday afternoon on an indictment issued by the Lane County Grand Jury.

Shirley shot Richard Allen Kelly, 38, on September 24 at Shirley's home in Springfield, police said. At the time, Shirley told officers he suspected Kelly was trying to steal his marijuana plants.

Police found Kelly in a nearby front yard with a gunshot wound. Officers seized Shirley's gun at the time.

Police said the Grand Jury is weighing charges of trespassing and third degree theft against Kelly in the incident.
