Jared is a 10-year-old child with a disability who is currently being prevented from accessing his education in the 4J school district. Beginning in February 2010, McCornack elementary in Eugene began the use of dangerous, unnecessary physical restraints and seclusion in response to behaviors that are consistent with Jared’s disability. Predictably, the teacher/student relationship deteriorated until in May of 2010, Jared’s mother witnessed 2 adults holding Jared face down on the floor of his classroom. Instead of working collaboratively with Jared’s family to find ways to support Jared, the district discriminated against Jared based on his disability when they unilaterally removed him from school in violation of Federal Law. Though Jared’s family has participated proactively in numerous district meetings over the past 7 months, 4j continues to use deception and intimidation to justify Jared’s continued removal from school.
